Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement ("Terms") govern your use of oh? ("oh?", "the app", "we", "us", or "our"), provided by Sunil Neurgaonkar.

By downloading, accessing, or using oh?, you agree to these Terms and to our Privacy Policy at https://ohapp.wtf/privacy If you do not agree, do not use the app.

1. Age Requirement

oh? is strictly for adults. You must be at least 18 years of age or older to use it.

By using oh?, you represent that you are at least 18 years old. If we learn or reasonably believe that you are under 18, we may block your access and delete or restrict information associated with your use of the app, subject to safety, abuse-prevention, legal, and security needs.

2. What oh? Does

oh? lets you create one small visual message each day and send it to one other user, chosen at random. Once a day, a message created by another user may appear on your device, including through a Home Screen widget. oh? is not a live chat, messaging, audio, or video service — there are no conversations, no real-time connections, and no way to contact another user directly.

Your identity is not intentionally shown to the recipient, and you will not see theirs, but you are responsible for the content you create and send.

You may optionally attach a song to what you send, using Apple Music. Attaching or playing songs is a convenience feature, not a music streaming service, and it is subject to the Apple Music terms described below.

3. Accountable Identity

oh? may require Sign in with Apple, iCloud, CloudKit, and age-assurance checks to operate the service, enforce the 18+ requirement, prevent abuse, and keep users accountable.

You may not use another person's Apple account, evade restrictions, or attempt to hide abusive behavior through multiple accounts or devices.

By signing in, you agree that we may send a small number of service-related emails to the email address associated with your Sign in with Apple identity (including an Apple private relay address), such as a welcome email or important notices about your account or the service. We do not send marketing emails.

4. User Content

You are solely responsible for anything you create, send, react to, or report through oh?.

You keep ownership of your content. By using oh?, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, moderate, display, transmit, and otherwise use your content as necessary to operate, secure, improve, and enforce the rules of the app.

Because oh? sends content to other users, do not include anything personal, confidential, sensitive, identifying, or unsafe in content you create.

"Content" includes any song you attach to a thing. You are responsible for the songs you attach, and you agree not to use them to harass, mislead, identify, or target another person.

5. Zero Tolerance for Objectionable Content and Abusive Users

oh? has zero tolerance for objectionable content or abusive users.

You may not create, send, upload, encourage, or attempt to distribute content that includes or promotes:

We may remove content, restrict features, block users, suspend access, preserve records for investigation, or take other action if we believe these Terms have been violated.

6. Moderation, Reporting, and Blocking

oh? may use automated rules, on-device checks, Apple-provided technologies, user reports, and manual review to detect and respond to objectionable content or abusive behavior. All content is screened before it is sent, on your device.

Users can report inappropriate content from within the app. You can also contact us at help@ohapp.wtf .

You can block any sender at any time. Once you block a user, you will never receive content from that user again.

We review reports of objectionable content and act on them within 24 hours by removing the offending content and ejecting the user who provided it. We may also remove content, suspend or permanently ban users, and restrict access, at our discretion, to keep oh? safe.

No moderation system is perfect. You agree that you may occasionally see content you dislike or find inappropriate, and your remedy is to report it and stop using the app if you do not want to continue.

7. Acceptable Use

You agree not to:

oh? lets you save a thing you received to your device's photo library and share it through your device's share options. Once you save or share content outside oh?, it leaves the app's protections and controls, and you are responsible for how you use and distribute it. Do not save or share content in any way that is unlawful, harassing, or abusive, or that would identify, target, or harm the person who sent it.

8. Purchases: oh? plus and gifts

oh? offers an optional one-time in-app purchase called oh? plus ("the forever thing"). It unlocks additional creative options in the editor, such as premium fonts, backgrounds, sticker art, motion stickers, and seasonal content. It is a single non-consumable purchase — not a subscription. Nothing renews, and nothing charges again.

oh? also offers an optional consumable in-app purchase ("a forever thing, for someone") that gifts oh? plus to a random stranger. You can buy gifts one at a time or in a small bundle. Buying a gift does not unlock anything for you — it never grants oh? plus to the buyer's own account.

9. Apple Music

oh? uses Apple Music, through Apple's MusicKit, to let you search for and attach a song to a thing, and to play a song you received. Your use of Apple Music content through oh? is subject to the Apple Media Services Terms and Conditions , and playback and catalog features may require Apple Music availability in your region and, for full-length playback, an active Apple Music subscription. oh? is not affiliated with, endorsed by, or sponsored by Apple Music beyond the use of Apple's provided technologies, and we do not control the availability of any particular song.

10. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using oh?, you agree to the Privacy Policy at https://ohapp.wtf/privacy .

To understand and improve the app, oh? collects pseudonymous usage analytics and session replays (with typed text masked), as described in the Privacy Policy. This data is never sold, never used for advertising, and never includes the content you create.

11. License

Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to use oh? on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.

You may not copy, modify, distribute, sell, rent, lease, sublicense, or create derivative works from the app except as expressly allowed by law.

12. Apple Terms

These Terms are between you and us, not Apple. Apple is not responsible for oh? or its content.

We, not Apple, are responsible for providing maintenance and support for oh?, to the extent required by applicable law.

Apple has no warranty obligation for oh?. If oh? fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple's policies. To the maximum extent permitted by law, Apple has no other warranty obligation for oh?.

We, not Apple, are responsible for addressing claims relating to oh?, including product liability claims, legal compliance claims, consumer protection claims, and intellectual property claims.

You must comply with applicable third-party terms when using oh?. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

13. No Warranty

oh? is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, secure, available in all locations, or free from objectionable user content.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or harm arising from user-generated content or your use of the app.

15. Termination

You may stop using oh? at any time.

We may suspend or terminate your access to oh? at any time if we believe you violated these Terms, created risk for other users, abused the service, or caused legal, safety, or security concerns.

Upon termination, your license to use oh? ends immediately.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date. Continued use of oh? after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
